Please read these Terms of Service ("Terms") carefully before using the Séance mobile application ("App") operated by Séance ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms.

1. Description of Service

Séance is an AI-powered mobile application that allows users to engage in simulated conversations with historical philosophers. The App uses artificial intelligence and retrieval-augmented generation (RAG) technology to generate responses styled after historical philosophical figures.

Important: All philosopher responses are generated by AI. They are creative interpretations and do not represent the actual views, advice, or endorsements of any historical figure. The App is intended for educational and entertainment purposes only.

2. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the App. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the App.

3. Account Registration

3.1 Account Types

  • Anonymous Access: You may use the App without registering. Anonymous accounts receive a limited number of free credits and have restricted functionality.
  • Registered Accounts: You may register using Sign In with Apple, Sign In with Google, or email/password. Registered accounts have access to the full feature set.

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Credits and In-App Purchases

4.1 Credit System

The App uses a credit-based system. Sending messages to AI philosophers consumes credits. Different interactions may consume different amounts of credits based on the complexity of the AI processing required.

4.2 Free Credits

  • New anonymous users receive a limited allocation of free credits.
  • Registered users may receive additional free credits upon registration or through promotions at our discretion.

4.3 Purchasing Credits

  • Credits may be purchased through in-app purchases via Apple Pay, Google Pay, or the respective app store payment systems.
  • All purchases are processed by Apple (App Store) or Google (Google Play) through RevenueCat. You are subject to the payment terms of the applicable app store.
  • Prices are displayed in your local currency and may vary by region.

4.4 Refund Policy

  • All credit purchases are non-refundable except as required by applicable law or the refund policies of the Apple App Store or Google Play Store.
  • If you believe a purchase was made in error, you may request a refund through the applicable app store:
  • Unused credits have no cash value and cannot be transferred, traded, or redeemed for cash.

4.5 Credit Expiration

  • Credits associated with registered accounts do not expire as long as the account remains active.
  • Credits associated with anonymous accounts expire after 90 days of inactivity.
  • We reserve the right to modify credit pricing and allocation with reasonable notice to users.

5. Acceptable Use

You agree not to use the App to:

  • Violate any applicable law or regulation
  • Harass, abuse, threaten, or harm others
  • Attempt to extract, reverse-engineer, or circumvent the AI systems or content generation mechanisms
  • Use automated tools, bots, or scripts to interact with the App
  • Attempt to manipulate the credit system or exploit vulnerabilities
  • Generate content that is illegal, harmful, or infringes on the rights of others
  • Impersonate any person or entity
  • Interfere with or disrupt the App's infrastructure or other users' experience
  • Use the App's AI-generated content to mislead others into believing it represents genuine philosophical authority or professional advice

6. AI-Generated Content Disclaimer

6.1 Nature of Content

All philosopher responses in the App are generated by artificial intelligence. They are:

  • Not real philosophical advice: Responses are creative simulations, not authoritative philosophical guidance.
  • Not historically accurate: While based on the philosophers' known works, responses are AI interpretations and may contain inaccuracies or anachronisms.
  • Not professional advice: Responses should not be relied upon as legal, medical, psychological, financial, or any other form of professional advice.

6.2 No Endorsement

The inclusion of any historical philosopher in the App does not imply endorsement by their estates, academic institutions, or any affiliated organizations.

6.3 Content Accuracy

We make reasonable efforts to ensure AI responses are contextually grounded in philosophical source material through our RAG system, but we do not guarantee the accuracy, completeness, or reliability of any AI-generated content.

7. Intellectual Property

7.1 Our Property

The App, including its design, code, AI models, curated philosopher knowledge base, and all related intellectual property, is owned by Séance and protected by applicable intellectual property laws.

7.2 Your Content

You retain ownership of the messages you send through the App. By using the App, you grant us a limited, non-exclusive license to process your messages for the purpose of generating AI responses and improving the service.

7.3 AI-Generated Responses

AI-generated philosopher responses are provided for your personal use. You may share or reference them, but you may not commercially redistribute bulk AI-generated content from the App without our prior written consent.

8. Account Suspension and Termination

8.1 By You

You may delete your account at any time through the App settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. Unused credits are forfeited upon account deletion.

8.2 By Us

We reserve the right to suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. Where possible, we will provide notice before taking such action.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be available at all times or without interruption
  • AI-generated responses will be accurate, complete, or suitable for any purpose
  • The App will be free from errors, bugs, or security vulnerabilities

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Séance SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Séance, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the App or violation of these Terms.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of The State of Colorado (United States of America), without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with American Arbitration Association (AAA) rules, except where prohibited by law. You may opt out of arbitration by notifying us in writing within 30 days of first using the App.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

If a change materially reduces your rights, we will provide at least 30 days' notice before it takes effect.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
